All products marketed by Castroni Boccea (hereinafter Castroni) are covered by the statutory guarantee of 2 years for defects, provided for in Article. 132 of the Legislative Decree. N. 206/2005. To use the warranty, the customer will keep the invoice (or DDT) that they will receive along with the purchased goods. The Customer may request a copy of any document through email.
The legal guarantee of two years, pursuant to Legislative Decree. N. 206/2005, applies to products that present a lack of conformity, provided it is used correctly, respecting its intended use and as provided in the technical documentation. This guarantee is limited only to the private consumer (a person who buys goods for purposes not related to his profession or making a purchase order form without indicating a VAT number). In case of lack of conformity, Castroni will, in accordance of article. 130 of Legislative Decree. N. 206/2005, according to customer requirements and provided that the type of product so permits, to restore, without charge, the conformity of the product by repair or replacement, or an appropriate price reduction or termination of contract.
If, for any reason, Castroni is not able to replace a warranted product, it may proceed with the consent of the customer, to replace the product with a product of equal value or similar characteristics and, finally, the issue of a discount amount equal to that spent by the customer, may be spent on another product, valid for six months from the time of release.
In cases where the return of the product is warranted, the product must be returned by the Customer in its original packaging, complete with all its parts (including packaging and any documentation and accessories). To limit damage to the original package, we recommend inserting, whenever possible, in a new box. It should be avoided in all cases, the attachment of labels or tape directly on the packaging of the product.
The cost of transportation of goods will be charged to the customer and returned to Castroni. In the event that the product sent appears to be working, the costs of transporting it to the customer will be charged to him/her.
The customer loses any right under art. 130 of Legislative Decree. N. 206/2005, if no complaint is made to Castroni for the defect by the deadline of 2 (two) months from the date on which this was discovered, as long as it is not a product, that by its nature, is perishable or subject to expire in a shorter period, in which case the defect must be reported within that reduced period.
For each product purchased by a Professional customer, they will benefit from a guarantee for defects in the goods sold in art. 1490 and seq. of the Civil Code; the amount of time the Professional customer has to enforce the guarantee against defects is the course of one year from delivery of the product purchased and its defects must be reported within the terms and conditions set by art. 1495 of the Civil Code.
